1.0 GENERAL
1.1 CulturalHubb Ltd is an incorporated New Zealand company and owns and operate this website. All CulturalHubb website activities come under New Zealand legal jurisdiction. Access to and use of this website and the products and services available through this website (collectively), are subject to the following terms, conditions and notices (the “Terms of Service”).
By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
1.2 CulturalHubb is committed to adhering to fair business practices. To this end we assure customers that the operation of this website follows the Model Code for Consumer Protection in Electronic Commerce published by the New Zealand Ministry of Commerce, and that we faithfully observe our obligations as set out by the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.
2.0 ORDER CANCELLATION
2.1 Though CulturalHubb website will endeavour to supply orders placed and accepted on this website, order placement and acceptance do not constitute an obligation on CulturalHubb website to supply. CulturalHubb website retains the right to refuse any request made by you and cancel any order without notice. CulturalHubb website obligations will be limited to protections provided by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
2.2. In event of any cancelled order, cheque or direct debt payments will be refunded in accordance with the Consumer Guarantees Act 1993. In the event that credit card payment is processed for a cancelled order, refunds will processed in accordance with the Consumer Guarantees Act 1993.
2.3 Customers who wish to cancel any order must notify CulturalHubb website by email by 10:00am on the next business day following the date of order.
3.0 PRICING
3.1 The purchase price displayed on the CulturalHubb website is for goods supplied and packed only. All prices quoted in this catalogue are GST exclusive. Prices displayed on the CulturalHubb website are subject to change without notice. Prices for items on an order are fixed once your order has been accepted. Subsequent price changes either up or down will not be retroactively applied to accepted orders. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable Purchase prices are given in New Zealand dollars unless otherwise stated. CulturalHubb Ltd is registered for GST and will issue a tax invoice which clearly identifies the GST component.
4.0 FAULTY OR DAMAGED GOODS
4.1 Whenever possible, CulturalHubb website will undertake to repair or replace any goods damaged prior to delivery. CulturalHubb website will undertake to repair or replace any faulty goods. Damaged or faulty goods will be either repaired or replaced at the discretion of CulturalHubb. Where repair or replacement of damaged or faulty goods is not possible a full refund will be issued for the value of the damaged goods. Damaged and faulty goods must be returned to CulturalHubb website in accordance with our returns policy.
5.0 RETURNS
5.1 The CulturalHubb website will only accept returns for the following:
- Goods damaged prior to delivery
- Goods with manufacturing faults
- Goods supplied incorrectly
- Goods that vary from their description on the CulturalHubb website

The CulturalHubb website will rectify any products delivered damaged or faulty, or errors in supply. Please return any damaged or incorrectly supplied goods in the original packaging. Returns can be addressed and posted to:

Please include a copy of the invoice or packing slip that accompanied your order. The invoice and packing slip also provide an area where you can indicate why you are returning any goods. If you are unable to provide a copy of the invoice or packing slip, include a note containing your name, address, order number, contact phone number, and reason for return.
You will be notified by email when your return is received. We will repair or replace damaged goods when possible; otherwise we will issue a full refund for the value of the damaged item(s). Postage costs will be reimbursed for the return of any damaged goods.
6.0 USE OF INFORMATION
6.1 You agree that we may obtain information about you from you or any other person in the course of our business, and you consent to any person providing us with such information. You must notify us of any change in circumstances that may affect the accuracy of the information you provided to us or our group of companies. (If you are an individual, i.e. a natural person, you have rights under the Privacy Act 1993 to access and request the correction of any personal information that we hold about you.)
7.0 OPEN & TRANSPARENT MANAGEMENT OF PERSONAL INFORMATION
7.1 The personal information we may collect about you could include your name, whether you are a parent or teacher, or educator, your e-mail address, name of educational institution or company, address, title, contact telephone, facsimile, country, any product purchases, and encrypted billing information. If connected to a business we may also collect the names and address of the directors, proprietors and owners, any personal guarantors and reports from credit reporting agencies, which is collected as part of our credit application processes.
7.2 Payments to CulturalHubb are made through both secure internal and third party payment gateways. CulturalHubb receives notification of the processing of payments from the secure internal and third party payment gateway in which any credit card information is provided in an encrypted format. We do offer links to third party websites on our websites. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of using that website and its privacy statement.
8.0 ANONYMITY & PSEUDONIMITY
8.1 CulturalHubb will not collect or monitor any personal information about an individual without their expressed or implied consent. Personal information is required for the purposes of establishing a relationship with our customers, performing the necessary credit checks in accordance with our credit application processes, providing and marketing our goods and services to customers and receiving payment for the same.
9.0 QUALITY OF PERSONAL INFORMATION
9.1 CulturalHubb relies on the personal information we hold to efficiently continue our business relationship with you. For this reason it is of utmost importance that the personal information we collect from you is accurate, complete and up to date. At times, we will ask you to inform us of any changes to your personal information, however you can contact us at any time to update your personal information or advise us if any information we hold is inaccurate or incomplete.
10.0 SECURITY OF PERSONAL INFORMATION
10.1 CulturalHubb ensures that your information is secure by protecting it from unauthorised access, modification and disclosure. We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems. We also maintain computer and network security; for example, we use firewalls and other security systems such as user identifiers and passwords to control access to computer systems.
10.2 We keep personal information only for as long as is reasonably necessary for the purpose for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.
11.0 NO LIABILITY
11.1 We shall not be liable for any delays or failure in complying with any obligation imposed on us under any contract or for any loss or damage (including indirect or consequential loss of profits, data or damage) as claimed by you.
11.2 Should any liability in relation to this agreement (or the goods supplied under this agreement) be imposed on CulturalHubb website for any reason, our total liability to you is limited to the price of those goods and services supplied by us to which the liability relates. We will not, in any case, be liable for any consequential or special damages, including loss of business profits.
11.3 If we are unable to provide our obligations under the terms of this agreement by reason of strike, lock-out, riot, industrial action, fire, storm, operation of law or other cause beyond our control, then we are released from our obligations under this agreement.
12.0 INDEMNITY
12.1 You hereby indemnify and will keep us indemnified against all obligations and liabilities incurred by an act or omission by you in relation to this agreement.
13.0 PRODUCT WARRANTY
13.1 Each item is intended for use only for the purpose described and not for any other purpose. Naturally, any item to be used by a child requires careful adult selection and use should be under proper adult supervision. Items must only be used by children of an appropriate age. Guidelines are given, but the final decision must be made by the selecting adult taking into account the nature of the child concerned. A photographic image may be required to support your warranty claim. In the instance that the CulturalHubb representative or customer service team deems the product to have been misused your warranty claim may not be honoured. Warranty Spare Part requests will take approximately three weeks. Some parts may need to be sourced from the manufacturer therefore lead times will be advised on application.
14.0 DESIGN CHANGES
14.1 We reserve the right to vary the specifications or performance criteria of any item from time to time and to obtain items from different sources, at our absolute discretion. We may do that without prior notice provided we have reasonable grounds for believing that the alternative item offered is substantially similar to that previously offered or represents an improvement.

15.1 This website cannot be reproduced (in whole or in part) in any form without the express permission of CulturalHubb Ltd.
16.0 DISCLAIMER
16.1 We believe the information in the website is correct at the time of publishing, but no representation or warranty is given with regard to the accuracy of such information.
17.0 OTHER AGREEMENTS
17.1 These terms apply to all transactions where we supply goods to you.
17.2 This agreement supersedes the terms of all prior agreements, understandings, representations or warranties previously given by us or any agent of CulturalHubb Ltd in respect of goods.
17.3 If there is any inconsistency between these terms and any order submitted by you or any other arrangement with us, these terms prevail unless otherwise agreed by us in writing.
17.4 If at any time any provision of this agreement becomes illegal, invalid or unenforceable neither the legal validity nor enforceability of the remaining provisions shall in any way be affected or impaired.
18.0 WAIVER
18.1 If we exercise or fail to exercise any right or remedy available to us, this shall not prejudice our rights in exercising that or any other right or remedy. Waiver of any term of the contract must be specified in writing by us and signed by an authorised person.
